First Appearance After Section 138 NI Act Summons in West Bengal

After receiving summons in a cheque-dishonour complaint, the accused should verify the complaint number, court, next date and latest order. A Section 138 complaint is a complaint case under a special statute, so the first response should be based on the process actually issued by the Magistrate rather than assumptions drawn from an ordinary police case.

Before the First Date

  • obtain the complaint, summons and latest order;
  • check the demand notice, cheque and return memo;
  • confirm the next date and whether any later process has issued;
  • engage counsel and prepare identification/address documents; and
  • identify connected complaints involving the same transaction.

Personal Attendance and Counsel

Supreme Court authority under Section 205 CrPC recognised that a Magistrate may dispense with personal attendance where insisting on it would cause substantial hardship without advancing the trial. The power is discretionary: the accused should seek an order rather than simply remain absent. The current procedural application should be framed under the provision applicable to the proceeding.

First Appearance Is Different From a Missed Appearance

A person responding promptly to a summons is in a different procedural position from an accused against whom coercive process has already issued. If the date has been missed, obtain the latest order before deciding the next application.

What Happens Next?

After appearance, the case may move through plea/particulars of accusation, complainant evidence, cross-examination, defence where required and final adjudication, subject to the procedure actually adopted by the Magistrate. Section 143 NI Act provides for summary trial of Section 138 cases subject to its statutory conditions.

FAQ

Can the first date be ignored if I live outside West Bengal?

No. Distance may support an appropriate application concerning attendance, but the summons and court order should be addressed on time.

Does counsel appearance automatically exempt me for the whole case?

No. The Magistrate may direct personal attendance later. General legal information only. The actual step depends on the summons, latest order and procedural stage.
