Warrant in a Section 138 NI Act Case in West Bengal After Missing Appearance
If an accused misses a date in a cheque-dishonour complaint, the first step is to obtain the latest order rather than assume that a warrant has—or has not—been issued. The appropriate response depends on the process actually ordered by the Magistrate and the history of appearance in that particular complaint.
Check the Order Before Travelling
Confirm the case number, court, date missed, reason recorded by the court, process issued and next hearing. Where several Section 138 matters are pending, check every case separately.
Exemption Is Not a Substitute for an Existing Warrant
An application seeking dispensation from routine personal attendance should not be assumed automatically to cancel coercive process already issued. Counsel should obtain the warrant/order and move the legally appropriate application before the competent Magistrate.
Outstation Accused
Where the accused resides outside West Bengal, the residence and travel burden may be relevant to future requests concerning personal attendance, but prior non-compliance and the existing order remain important. The Magistrate retains discretion to require personal appearance.
Documents for Urgent Review
- summons and all later process;
- latest order sheet;
- earlier bail/bond or exemption orders;
- proof explaining the missed date where relevant;
- current address and identification; and
- a list of all connected Section 138 cases.
