Section 138 NI Act Summons at Bankshall Court: Guide for Outstation Accused
If you live outside West Bengal and receive summons in one or several cheque-bounce complaints under Section 138 of the Negotiable Instruments Act before a Metropolitan Magistrate in Kolkata, the immediate issue is usually not whether every hearing requires travel to Kolkata. The first tasks are to verify each case, the summons and next date, identify whether any warrant has already been issued, engage counsel, and determine what form of appearance or exemption the Magistrate will permit.
Do Not Ignore a Bankshall Court Summons
Different complaints can be at different procedural stages even when they arise from related transactions. Prepare a case-wise chart containing the complaint or case number, court, complainant, cheque number and amount, summons date, next hearing, and the latest order. If there are several matters, do not assume that an order or appearance in one case automatically protects the accused in every other case.
Can an Out-of-State Accused Appear Through an Advocate?
Section 228 of the Bharatiya Nagarik Suraksha Sanhita, 2023 permits a Magistrate who issues summons, where the Magistrate sees reason to do so, to dispense with the accused's personal attendance and permit appearance through an advocate. The power is discretionary. The Magistrate can later require personal attendance at any stage. The Supreme Court's decision in
Bhaskar Industries Ltd. v. Bhiwani Denim & Apparels Ltd. recognised under the corresponding Section 205 CrPC framework that, in an appropriate summons case, a Magistrate can permit even the first appearance through counsel. The Court also identified safeguards such as an undertaking concerning identity, representation by counsel and proceeding with evidence in the accused's absence. The decision does not create an automatic right to remain absent.
Why Residence Outside West Bengal Matters
Distance is relevant to an exemption request, but it is not by itself a guarantee. The application should accurately state the accused's residence, travel burden, willingness to be represented on every required date, undertaking not to dispute identity, and willingness to appear personally whenever directed. The exact application should be adapted to the orders already passed in each case. The Supreme Court in
In Re: Expeditious Trial of Cases under Section 138 of the NI Act also directed that where an accused resides beyond the territorial jurisdiction of the court, the prescribed inquiry before proceeding against the accused must be conducted. That issue concerns the process leading to summons and should be examined from the complaint and court record rather than assumed from the accused's address alone.
What About Video-Conference Appearance?
Current criminal procedure recognises audio-video electronic means in relevant contexts, and courts increasingly use virtual facilities. Whether a particular hearing can be attended electronically depends on the applicable procedural provision, court facilities and the Magistrate's order. An accused should obtain permission rather than simply joining remotely or remaining absent on the assumption that video appearance will be accepted.
Is Bail Required in a Section 138 Case?
A Section 138 complaint is a summons-case prosecution under a special statute. After summons, counsel should inspect the exact process issued and the latest order before deciding what appearance, bond, bail or exemption application is required in that court. The procedural response should not be copied from an ordinary police FIR case. If a bailable or non-bailable warrant has already been issued because of non-appearance, the warrant and the order leading to it require immediate case-specific attention.
Multiple Section 138 Cases in Bankshall Court
Where the same accused faces multiple cheque complaints, counsel should first map whether they arise from the same transaction, the same complainant, related cheques or unrelated liabilities. The Supreme Court's 2021 directions addressed the problem of multiple Section 138 complaints, including service of summons in complaints forming part of the same transaction before the same court. That does not mean that separate complaints automatically merge into one case.A practical case-management request may seek coordinated dates or appropriate procedural directions where legally available, but each complaint, exemption order, warrant and settlement position should still be tracked separately.

What If a Warrant Has Already Been Issued?
Do not treat an exemption application as an automatic substitute for dealing with an existing warrant. Counsel should obtain the relevant order, identify why the warrant was issued and move the legally appropriate application before the competent court. The court may require personal attendance depending on the history and circumstances.
Settlement and Compounding
Section 147 of the Negotiable Instruments Act makes offences under the Act compoundable. Where settlement is commercially sensible, multiple complaints should be mapped carefully so that the settlement identifies every cheque, complaint and payment obligation intended to be resolved. A private payment arrangement should not be assumed to have closed a pending criminal complaint until the necessary court steps are completed.

Frequently Asked Questions
I live outside West Bengal. Must I come to Kolkata on every date?
Not necessarily. A Magistrate has statutory power to dispense with personal attendance in an appropriate case, but exemption is discretionary and can be withdrawn or personal attendance directed later.
Can my advocate make my first appearance?
Supreme Court authority recognises that this can be permitted in an appropriate summons case when personal appearance is dispensed with. Whether it will be allowed depends on the application, undertakings, procedural stage and the Magistrate's order.
I have five or ten cheque-bounce cases. Is one exemption application enough?
Do not assume so. Each complaint is a separate proceeding unless the competent court has made an order affecting those proceedings. Counsel should check and obtain appropriate orders case by case.
Can I seek video-conference appearance?
It may be requested where legally and technically available, but remote appearance should be based on court permission and the applicable procedure rather than assumption.
What should I do if I missed the summons date?
Check the latest order immediately. The response differs depending on whether the matter was simply adjourned, coercive process was issued, or a warrant is outstanding.
