Section 138 NI Act Summons in West Bengal: Guide for Outstation Accused

Section 138 NI Act Summons in West Bengal for an Outstation Accused

A person living outside West Bengal may receive a summons in a cheque-dishonour complaint pending before a Magistrate in Kolkata or another district of West Bengal. The safest response is to verify the case, obtain the complaint and latest order, identify the next date, and arrange representation before deciding whether personal attendance, appearance through counsel or an exemption application is appropriate.

Why the Accused's Residence Matters

The Supreme Court's directions concerning Section 138 complaints require an inquiry to determine whether sufficient grounds exist to proceed where the accused resides beyond the territorial jurisdiction of the court. This does not mean that every summons issued to an outstation accused is invalid. The complaint, inquiry and process order must be examined on their own record.

Can Appearance Through an Advocate Be Requested?

Section 228 BNSS permits a Magistrate issuing summons, where the Magistrate sees reason to do so, to dispense with personal attendance and permit appearance through an advocate. The power remains discretionary and personal attendance can later be directed. Supreme Court authority under the corresponding CrPC framework has recognised the hardship of repeated travel where an accused lives far from the court.
