Multiple Section 138 NI Act Cases in West Bengal
A business owner, director, guarantor or individual may discover that several cheque-dishonour complaints are pending in West Bengal. The immediate task is case management: identify every complaint and its procedural stage before making assumptions about common dates, common representation or settlement.
Create a Case-Wise Matrix
Record the court, case number, complainant, cheque number, amount, statutory notice, summons status, next date, latest order, appearance status and any warrant for every complaint.
Same Transaction Does Not Automatically Mean One Case
The Supreme Court's directions on expeditious trial of Section 138 cases addressed multiple complaints and service of summons where complaints before the same court concern cheques forming part of the same transaction. Those directions do not mean that separate complaints automatically cease to exist or that an order in one complaint automatically applies to every other proceeding.
Appearance and Exemption
If the accused lives far from the relevant West Bengal courts, counsel can examine whether an application concerning personal attendance is appropriate. Each case should be checked for its own order because a favourable exemption order in one proceeding should not simply be assumed to govern another.
Settlement Across Multiple Cases
Section 147 NI Act makes offences under the Act compoundable. A multi-case settlement should identify the specific cheques, complaint numbers, payment terms and court steps intended to resolve each proceeding. Payment alone should not be assumed to have formally disposed of every pending complaint.
