Section 138 NI Act Legal Notice: Defence Issues an Accused Should Check

The statutory demand notice is a critical document in a cheque-dishonour case. Preserve the notice, envelope or electronic service material and the underlying transaction papers before responding.

Check the Record

  • cheque identified and amount;
  • dishonour date and bank reason;
  • liability asserted;
  • date and mode of service;
  • payments or adjustments already made;
  • contract, invoices or loan papers; and
  • whether a written reply is appropriate.
A perceived defect should not automatically be assumed to defeat a later complaint; statutory compliance is assessed from the notice and surrounding record.See the defence document checklist and cheque bounce defence assistance.General legal information only.
