A CAT Kolkata service matter should first be checked for statutory and territorial jurisdiction. The Central Administrative Tribunal’s Kolkata Bench hears service matters within its statutory jurisdiction. A central-government connection does not by itself answer every forum question: the employer, post, statutory coverage, challenged decision, available departmental remedy and relief must be examined first.

Before preparing a tribunal application, identify who appointed the employee, which service rules govern the post, what order or inaction is challenged, and whether a representation, appeal or other departmental step has already been used. The application should be built from the service record rather than from a general narrative alone.

A seven-step preparation process

  1. Identify the service relationship. Confirm the employer, appointing authority, post, cadre and current status.
  2. Locate the governing instruments. Collect the recruitment rules, appointment terms, service rules, circulars and relevant policy documents.
  3. Define the impugned action. Isolate the recruitment, transfer, disciplinary, promotion, seniority, pay, pension or retirement decision in issue.
  4. Map the departmental record. Arrange representations, appeals, review requests, acknowledgements and responses in date order.
  5. Assess CAT jurisdiction. Check the statutory coverage, territorial connection, parties and relief rather than assuming the forum.
  6. Prepare a document-led chronology. Link each material event to the corresponding order, communication or record.
  7. Review the relief sought. Ensure that the requested directions respond to the actual service decision and procedural history.

Documents for an initial review

The useful record may include the recruitment notice, application and selection result, appointment and confirmation letters, posting and transfer orders, service-book extracts, seniority or promotion lists, annual assessment records where relevant, charge sheet, reply, enquiry papers, final order, departmental appeal, pension papers and prior court or tribunal orders. Requirements vary by dispute.

Forum and official sources

The Administrative Tribunals Act, 1985 provides the statutory framework for administrative tribunals and their service jurisdiction. The Central Administrative Tribunal’s official portal and Kolkata Bench case-information portal provide current institutional and case-management information. Current filing rules and official directions should be checked when preparing a matter.

Common mistakes

  • naming the forum before confirming statutory coverage;
  • filing an incomplete chronology without the operative order;
  • relying on an oral assurance when written records exist or should be requested;
  • mixing several independent grievances without identifying the decision under challenge;
  • omitting prior representations, appeals or proceedings;
  • assuming that every procedural defect produces the same remedy.

Frequently asked questions

Does CAT Kolkata hear every employment dispute?
No. Private employment and service relationships outside the Tribunal’s statutory coverage may require a different forum.
Is a departmental representation always compulsory?
Under section 20 of the Administrative Tribunals Act, CAT ordinarily requires available remedies under the relevant service rules to have been used. The Act also addresses when those remedies are treated as exhausted. Review the departmental record and limitation promptly; do not assume that repeatedly sending representations keeps a claim in time.
Can tribunal proceedings be prepared without the complete service file?
An initial assessment can begin with available records, but missing orders, rules or departmental papers may affect the forum, grounds and relief.
Does the Kolkata Bench cover all central employees working in West Bengal?
Territorial jurisdiction and statutory coverage should be checked against the employee, employer, cause of action and current official framework.
Does CAT use exactly the same procedure as a civil suit?
Section 22 says the Tribunal is guided by natural justice and is not bound by the Code of Civil Procedure’s procedural framework. The Act and applicable tribunal rules still govern the proceeding. Document preparation and compliance with directions remain important.
Can an applicant appear without an advocate?
Section 23 permits an applicant to appear in person or obtain assistance from a legal practitioner of their choice. Personal appearance does not remove the need to meet filing requirements and procedural directions.
