Writ Petition Against a Public Authority: Calcutta High Court First Assessment
A writ petition requires more than an adverse administrative decision. The applicant should identify the public duty, legal right, impugned action, decision-maker, record, and relief that the High Court can appropriately grant.
First assessment
- Is the respondent performing a public function?
- Is there an appeal, tribunal, or statutory remedy?
- Is the action without jurisdiction, arbitrary, procedurally unfair, or contrary to law?
- Has delay or disputed evidence changed the suitability of writ review?
The High Court may decline interference where disputed facts or an effective alternative remedy dominate, subject to established exceptions. The remedy must be assessed, not promised.
