Before filing an appeal, revision or review, the first step is to read the order carefully. Many weak filings arise because the client reacts to the result without identifying the legal reason for challenge.

Start with the operative portion

The operative portion tells what the court actually directed. Check whether the case was dismissed, allowed, partly allowed, disposed of with liberty, or kept pending with directions.

Identify findings and reasons

An appellate court usually examines reasons, findings, evidence and legal conclusions. Mark the paragraphs where the court accepted or rejected key arguments.

Check limitation and certified copy

Note the date of order, date of uploading, certified copy application and any time-bound compliance. Delay strategy should not be left until the last moment.

Match remedy to grievance

An unfavourable direction may call for appeal, review, modification, clarification, revision, writ or compliance strategy. The correct route depends on the statute and order type.

Client checklist

Prepare the order, pleadings, annexures, hearing notes, prior orders and a short note explaining what harm the order causes. This article is general legal information only.
