Police Inaction Writ Petition Assessment in West Bengal
When a complaint appears not to have received an effective police response, the correct remedy depends on what was reported, whether an FIR exists, the investigation stage and the statutory remedies already used.

Alternative-remedy assessment
The BNSS provides statutory routes involving police authorities and the Magistrate. Recent court treatment shows that a writ petition should not be assumed to be the first or automatic remedy for every allegation of police inaction. Counsel should assess maintainability, urgency, public-law elements and available statutory steps.

When High Court review may require consideration
Exceptional facts, failure to perform a public duty, an existing judicial direction or another legally material circumstance may require separate assessment. The appropriate relief must be framed from the record and current authorities.
Questions for a focused assessment
- Was the complaint delivered to the correct police authority, and is receipt documented?
- Has an FIR been registered, and what is the current investigation status?
- Were available representations or Magistrate remedies used, and what orders were passed?
- Is the complaint about non-registration, investigation quality, enforcement of an order or another public duty?
- What immediate prejudice or urgency is shown by the record?
These questions help distinguish a statutory criminal-procedure remedy from an exceptional public-law issue. They do not predetermine whether a writ petition is maintainable.
